Acceptable Use Policy

Operator#

PowaHub is operated by CertainData Ltd, a company registered in England & Wales under company number 17354647 (official name: CERTAIN DATA LTD), whose registered office is at Venture House, 2 Arlington Square, Downshire Way, Bracknell, Berkshire, RG12 1WA. In this Policy, "PowaHub", "we", "us" and "our" refer to the PowaHub platform operated by CertainData Ltd.

You may use PowaHub only for lawful purposes and in accordance with this Acceptable Use Policy, the Terms of Service and any other agreement that applies to your account.

Prohibited uses#

You may not use PowaHub to facilitate, support or enable:

any activity that violates applicable law or regulation;
sanctions evasion, dealings with sanctioned parties, or attempts to circumvent applicable sanctions controls;
money laundering, terrorism financing or proliferation financing;
fraud, identity theft, impersonation, credential theft, phishing or unauthorised account takeover;
child sexual abuse material, non-consensual intimate imagery, or other unlawful or seriously harmful content;
malware, ransomware, viruses, malicious code or infrastructure intended to compromise systems or users;
unauthorised probing, scanning, exploitation or disruption of PowaHub or third-party systems;
attempts to bypass, disable, evade or interfere with authentication, rate limits, access controls, security controls or other service safeguards;
infringement of intellectual-property rights, confidentiality obligations, privacy rights or data-protection laws;
unlawful collection, use, sale, disclosure or redistribution of personal data;
harassment, threats, abuse or conduct intended to cause unlawful harm to another person or organisation;
building competing data marketplaces by aggregating and reselling paid responses outside the applicable source licence; or
concealing or misrepresenting identity, transaction purpose or source of funds where done to facilitate fraud, evasion or unlawful activity.

Provider conduct#

Providers must not list data or services they do not have the right to redistribute or make available. Providers must not misrepresent data quality, freshness, coverage, provenance or licensing and must comply with any Seller Agreement or other provider terms applicable to their account.

Providers remain responsible for their own legal, regulatory, financial-crime and sanctions obligations. PowaHub does not perform sanctions or AML screening of sellers, their principals or their wallets. Coinbase may apply its own wallet and transfer screening controls in connection with Coinbase services, and sellers are responsible for resolving any restriction, block or compliance issue directly with Coinbase or their chosen off-ramp provider.

Buyer conduct#

Buyers must use purchased data and services only in accordance with applicable law, the relevant source licence and any contractual restrictions. Buyers must not remove or circumvent licensing controls or redistribute paid responses except where the relevant licence expressly permits it.

Enforcement#

We may investigate suspected violations of this Policy and may suspend or terminate access where reasonably necessary to protect users, providers, PowaHub or third parties, or to comply with legal or regulatory requirements. Material or repeat violations may be reported to relevant authorities where appropriate or required by law.
